"Access to Medical Records from RDASH"

About: Rotherham Doncaster and South Humber NHS Foundation Trust

(as the patient),

I wanted to see what was contained within my medical records since the staff at RDASH had made it difficult for me to get my driving licence back.

I wrote to RDASH in September 2012 to request these notes under the Data Protection Act and the Freedom of Information Act. To date (January 2013) I have still not received copies of my notes.

I have emailed RDASH on numerous occasions to see what is happening, but I feel that I am just get fobbed off with excuses. They have failed their legal obligation under the Data Protection Act, which I believe gives them 40 days to provide this information. It feel like nobody at RDASH seems bothered and they are treating me like I am merely a number to them.

I do not know who I should raise this concern with and that is why I have put this post on this website.

Dear phatboyjim,

Thank you for taking the time to make this posting. I am sorry to hear that you are unhappy with the manner in which the Trust has dealt with your request.

I shall forward your posting to the appropriate managers, for them to offer a response. The Trust takes Freedom of Information requests very seriously and I would advise you to contact the Information Governance Manager on 01302 796189.

You can also contact the Patient Advise and Liaison Service (PALS) on 0800 015 4334 or pals@rdash.nhs.uk

Best Wishes,

Nick

“Dear phatboyjim,

Thank you for your posting. Without knowing the specifics of your request we cannot provide a specific answer, however we do take our obligations to provide information when requested seriously.

There may be a number of factors that have caused a delay. One such example is that a manager has to read through all of the records requested to remove any third party information as we are not able to release this. If someone has been in receipt of services for a number of years then we may hold a large volume of clinical records so this would be a time consuming task. Should there be a reason such as this then this should have been communicated to you.

If you wish to speak to someone further about your request then please contact the Information Governance Manager on 01302 796189.

Kind regards,

Wendy
